IMBRA COMPLIANCE
If you are a US citizen or are currently residing in the US, and you request the personal contact information of any lady and the lady consents to the release of her information, the International Marriage Broker Regulation Act (IMBRA) requires that we search for your name in the National Sex Offender's Registry. If you are in this registry, you will not be allowed to use our services and you will be discontinued as a member.
If you request the personal contact information of a lady you are also required by IMBRA to complete a background information form. In order to access the form you must sign up then log in and click "IMBRA Compliance".

GENERAL TERMS

Your-lovestory.com is an international online service operated by Best Brides World Wide, LLC. ("BBW"). If you wish to become a registered member ("Member") and utilize your-love story.com’s services, including, but not limited to email messaging, live instant messaging, live video streaming, and gift delivery ("Services"), you must agree to abide by the terms and conditions ("Agreement") defined herein. If you do not agree to these terms and conditions, you may not utilize the Services provided in this web site ("Web site") and should exit the Web site immediately.
This Agreement defines the terms of your use regarding the Web site and your Membership while utilizing the Services. Any provisions governing the use of “BWM” Services including but not limited to its Terms and Conditions, User Agreement, and Disclaimer may be amended, revised, or added to without prior notice of any kind. It is each Member's sole obligation and responsibility to periodically review all provisions governing the relationship of the parties defined in this Agreement and adhere to the rules outlined therein.

•  Important Information. In compliance with the Violence Against Women and the Department of Justice Reauthorization Act of 2005 (“H.R. 3402”) which contains the International Marriage Broker Regulation Act of 2005 (“IMBRA"), the following Agreement, is a precondition to any Services provided by “BBW” and its affiliates, whether those Services are secured through its websites, agents, employees, or by any other means.

All Members who utilize the Services agree to abide by the provisions of the IMBRA. Any act or attempt, either willful or inadvertent, on the Member’s part solely, or in concert with a Foreign National Client, or in concert with another online service, whether of domestic or foreign registry, to circumvent the information notification and release provisions of the IMBRA, is a violation of that Act. Each Member agrees to assume full responsibility personally and to indemnify and hold harmless “BBW” from any criminal or civil liability associated with such acts or attempts.

Generally speaking, Members who reside in the United States or who are United States citizens, that become interested in obtaining personal contact information or in arranging in-person meetings with Foreign National Clients who have profiles on the Web site, are prohibited from having any direct communications with those Foreign National Clients until full compliance with the IMBRA information notification and release provisions have been fulfilled. For purposes of this Agreement, the term “Foreign National Client” refers to women who list their profiles on the Web site, reside outside the United States, and are not United States citizens. Members interested in obtaining personal contact information as defined by the IMBRA, or in arranging in-person meetings with Foreign National Clients, will be referred to an Independent Company/Agency Representative ("ICAR") within the country Ukraine who will assist him with his request.

“BBW” and the ICAR will provide all the tools, steps, and services necessary to comply with the background information notification and release requirements of the IMBRA, which, in compliance with the law, are prerequisites to facilitating the exchange of personal contact information and/or in-person meetings between Foreign National Clients and Members who utilize the Services.

 
“BBW” will:

• In the IMBRA section of our site, male clients will be able to produce and fill out the IMBRA Client Attestation Form. “BBW” will submit the clients name to the “National Sex Offender Public Registry” and “The State Sex Offender Public Registry”. If member’s results are negative, “BBW” will submit the client attestation form to the ICAR. The ICAR will facilitate translation of the background information contained within the form, and forward it to the Foreign National Client. Depending on the Agency, a service fee will be collected. If the results are positive, male member will be discontinued from the agency.

ICAR will:
1.  Secure the Foreign National Client’s signed release, only if, after reviewing the Client Attestation, the                 Foreign National Client agrees to meet with the Member and/or authorizes the disclosure of her personal contact information to the Member.

• Facilitate the exchange of personal contact information and/or provide travel services in compliance with IMBRA regulations, so, should the Member and Foreign National Client decide to apply for a U.S. K-1 visa or pursue any country's immigration options in the future, the potential obstacles to the process are mitigated to the greatest extent possible.
  
  Given the dynamic nature of immigration requirements and policies worldwide, “BBW” assumes no responsibility or liability whatsoever with regards to the acquisition of any visa, immigration status, or other desired immigration objective, that may or may not be affected by a Member’s or Foreign National Client’s participation in the Services provided on the Web site. Therefore, “BBW”, its affiliates, and their employees, officers, directors, representatives, and assigns, have no liability whatsoever and shall be held harmless by all Members against any liability with regard to any and all immigration matters that may or may not be affected by their use of the Services provided on the Web site.

IMBRA Disclaimer. “BBW” secures and electronically stores an executed United States Client Attestation form as well as any support documentation provided by its Members to an ICAR. Additionally, the ICAR utilizes the United States Justice Department’s web site to check the National Sex Offender Public Registry and State Sex Offender web sites as per IMBRA requirements. However,  “BBW” has no way of ascertaining the authenticity of any documentation, or how current the information or images are that a Member may provide. Further, “BBW”  does not verify the accuracy of the information supplied by Members on the United States Client Attestation form, conduct independent individual or criminal background checks, or certify the information Members provide for their profile, including but not limited to, age and marital status. Therefore, “BBW” makes no warranty either express or implied that the information contained within a Member’s profile is truthful and accurate or that a Member is available and/or eligible for marriage. “BBW” expressly forbids Members that have been convicted of a felony, are a convicted sex offender, or are under the age of 18 from becoming Members of the Web site. Therefore, in addition to “BBW’s” stated policy of reserving the right to deactivate any Member’s profile and access to the Web site with or without cause, “BBW” will not allow persons of whom it has knowledge are convicted felons, sex offenders, or who are under the age of 18 to participate in Web Site Services. However, “BBW” assumes no liability for any deactivation due to information from any source that may incorrectly identify a Member as ineligible to participate in Web site Services, whether the incorrect identification is due to electronic or human error. Additionally, “BBW” assumes no liability as a result of individuals who supply false information and/or false or misleading documentation on the United States Client Attestation form and/or within their profile. “BBW”  expressly warns Foreign National Clients that undesirable individuals who supply false information and/or supply false or misleading documentation may gain access to Web site Services. As a result, “BBW”, its affiliates, and their employees, officers, directors, representatives, and assigns will not be liable for any direct, indirect, incidental or consequential damages arising out of a Foreign National Client’s participation on an “BBW” Web site, including but not limited to, financial loss, physical damages, bodily injury, and emotional distress.

“BBW” secures and electronically stores the passports and any other documentation provided by Foreign National Clients to an ICAR, in order to validate the information contained within their profiles. However, “BBW” has no way of ascertaining the authenticity of any documentation, or how current the information or images provided by a Foreign National Client are. Further, IPG does not conduct independent individual or criminal background checks on its Foreign National Clients. Therefore, “BBW” makes no warranty either express or implied that the information contained within a Foreign National Client’s profile is truthful and accurate or that a Foreign National Client is available and/or eligible for marriage. “BBW” expressly forbids Foreign National Clients who have been convicted of a crime or are under the age of 18 from maintaining profiles and participating in the Services on the Web site. Therefore, in addition to “BBW’s” stated policy of reserving the right to deactivate any Foreign National Client’s profile and access to the Web site with or without cause, “BBW” will not allow persons of whom it has knowledge have been convicted of a crime or are under the age of 18 to participate in Web Site Services. However, “BBW” assumes no liability for any deactivation due to information from any source that may incorrectly identify a Foreign National Client as ineligible to participate in Web site Services whether the incorrect identification is due to electronic or human error. Additionally, “BBW” assumes no liability as a result of individuals who supply false information and/or supply false or misleading documentation to support the information supplied within their profile. “BBW” expressly warns Members that undesirable individuals who supply false information and supply false or misleading documentation may gain access to Web site Services. As a result, “BBW”, its affiliates, and their employees, officers, directors, representatives, and assigns will not be liable for any direct, indirect, incidental or consequential damages arising out of a Member’s participation on an “BBW” web site, including but not limited to, financial loss, physical damages, bodily injury, and emotional distress.
All Members and Foreign National Clients participating in the Web site Services assume all risks associated with using the web site, which may include but are not limited to, the possibility of being scammed for purposes of illegally obtaining United States visa status, the possibility of being financially or emotionally exploited, of being physically or emotionally abused, of being stalked, hurt, or harassed, whether electronically through email and/or instant messaging, verbally, or otherwise, and the possibility of incurring bodily injury up to and including death.

•  Right to Use. The Web site may only be used for lawful purposes by Members seeking to form friendships through online correspondence. You must be 18 years of age or over to register as a Member of
your-lovestory.com. By registering, you acknowledge that you possess the capacity to enter into this Agreement and to abide by all restrictions defined herein. “BBW” may alter, suspend, or discontinue any aspect of the Services at any time, the reason for which “BBW” may or may not disclose. This includes limiting your use of part or all of the Services. Suspension of Services may be with or without notice, the determination of which is at the sole discretion of “BBW”.

•  Member Login ID and Password. During the registration process, you will create a unique username and password that is associated with your new account. You are solely responsible for maintaining the confidentiality of your password, and are fully accountable for all activities that occur under your account. You are prohibited from sharing your password with any third party and from using your password for any unauthorized purpose. You may not assign or transfer access privileges to any other person or entity. You agree to notify “BBW” of any unauthorized use of your account or any other breach of security.

•  Duration. This Agreement will remain in effect while you use the Web site and/or are a Member. Even after your membership ends, certain sections of this Agreement will still apply. You may terminate your membership at any time by selecting "inactive" in your Account page. Unused Credits that are present in your account are non-refundable. “BBW” reserves the right to terminate your membership at any time. If “BBW” terminates your membership because you are found in violation of this Agreement, access to your account will be severed immediately.

•  Use for Commercial Gain. The Web site is reserved for the personal use of individual Members only and may not be used for commercial gain. Organizations, companies, and/or businesses are prohibited from using the Services or the Web site for any purpose, commercial or otherwise. Illegal and/or unauthorized use of the Web site will be prosecuted to the fullest extent.

•  Exclusive Rights. The contents of the Web site and all other web sites under “BBW” control, including but not limited to text, graphics, images, logos, button icons, software, and other Web site content, are the sole property of “BBW” and are protected by law. Users agree not to copy, modify, adapt, reproduce, translate, distribute, transmit, reverse engineer, or dissemble any aspect of the Web site, including Web site content, and acknowledge that doing so may lead to civil and/or criminal liability for violations of trademark, copyright, and/or other applicable laws.

•  Security. Users and unauthorized third parties are prohibited from violating or attempting to violate the security of the Web site, including, without limitation, accessing data not intended for such user, logging into a server or account which the user is not authorized to access, attempting to probe, scan, or test the vulnerability of a system or network, breaching security or authentication measures without prior authorization, attempting to interfere with service to any user, host, or network by means of a virus, or any type of denial of service attack, sending unsolicited email, including promotions and/or advertising of products or services, or forging any TCP/IP packet header or any part of the header information in any email. “BBW” is not responsible for the loss or misuse of any data or member information that is obtained by unauthorized access or through the illegal acts of any user or any third party. Violations of the system or network security may result in civil or criminal liability. “BBW” will investigate occurrences that may involve such violations, and may involve and cooperate with law enforcement authorities to prosecute users found guilty of such violations.

•  Acceptable Content. You agree that “BBW” may review and delete any messages, photos, profiles, or other material (collectively, "Content") that violates the acceptable content policy as defined herein.

•  You are solely responsible for the Content that you post or transmit to other Members while utilizing the Services.

•  The following defines the type of Content prohibited on the Web site whether it be in your profile, email messages, or instant messages. This list is condensed and not inclusive of all Content forbidden on
your-lovestory.com. “BBW” reserves the right to remove any Content similar in part or in full to that which is listed below, as well as any Content not mentioned below that is deemed inappropriate. Members who violate this acceptable content policy may be banned from any current and future use of the Services. Unacceptable Content includes Content that:

•  displays or describes pornographic or sexually explicit material of any kind;
•  promotes harassment, racism, or physical harm of any kind against any group or individual;
•  displays language of a harassing, abusive, or vulgar nature;
•  involves the transmission of "junk mail" or unsolicited mass mailings;
•  promotes or refers to, in any shape or form, our competitor's services and/or web sites;
•  promotes obscene, offensive, illegal or otherwise objectionable material;
•  disseminates an illegal or unauthorized copy of another person's copyrighted work;
•  provides instructional information concerning illegal activities;
•  contains viruses, Trojan horses, worms, time bombs, cancel bots, or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or information;
•  solicits passwords or personal identifying information from other users for commercial or unlawful purposes;
•  disseminates telephone numbers, postal addresses, URLs, instant message IDs, email addresses or any other form of personal contact information.

•  Privacy Policy. “BBW” considers your personal data as confidential, and has developed a Privacy Policy outlining the personal data collection and use practices of “BBW”. By using the Web site, users are assumed to be familiar with, and agree to, the conditions and limitations in the Privacy Policy.

•  Copyright Policy. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information contained within the Web site without first obtaining prior written consent from “BBW”.

•  Links. The Web site may contain links to other third party web sites. These links are provided solely as a convenience to you and not as an endorsement by “BBW” of the contents of such third party web sites. “BBW” is not responsible for the content of linked third party web sites and does not make any representations regarding the content or accuracy of materials on such web sites. If you choose to access a linked third party site, you do so at your own risk.

•  Member Disputes. Members are solely responsible for their interactions with one another. “BBW” has no obligation to monitor any disputes that may arise between any Members.

•  Disclaimers. “BBW” cannot guarantee and does not warrant any specific results from use of the Web site and/or the Services. The Web site and Services are distributed on an "as is" basis. “BBW” is not responsible for any incorrect or inaccurate content posted on the Web site, regardless of its origin. You acknowledge that errors, omissions, and interruptions in the availability of the Services may occur, and hold “BBW” harmless from any loss or damage incurred by you as a result of such occurrences. “BBW” is not responsible for the conduct, whether online or offline, of any Member of the Web site. IPG will not be responsible for any loss or damage resulting from the interactions between users of the Web site, whether online or offline. To provide the Services, “BBW” purchases services from various ICARs located within the former Soviet Union. The ICARs providing services for your-lovestory.com are independent contractors and are not employees of “BBW”. “BBW” is not responsible for the willful or negligent acts of any ICAR or its respective employees, including their failure to deliver services in part or in full. Each ICAR is responsible for validating it's own ladies. They are contractually bound to conduct these validation practices in a professional and ethical manner.

SPECIAL ALERT!
“BBW” expressly warns all Members that sending money to any Foreign National Client does not guarantee or secure the further development of an existing relationship and could result in significant financial loss.
Should a Member choose to send information to any Foreign National Client, including, but not limited to Money Transfer Control Numbers (MTCN’s), personal account information connected to online payment transfer services, personal account information connected to financial institutions such as bank routing transit numbers, checking account numbers, and/or savings account numbers, or any other type of information that could help facilitate the exchange of money between the Member and a Foreign National Client, “BBW”, its affiliates, and their employees, officers, directors, representatives, and assigns will not be liable for any direct, indirect, incidental or consequential damages that could arise as a result, including, but not limited to financial loss and emotional distress.

• Limitation of Liability. “BBW” shall employ due care and attention in maintaining the Web site. However, you acknowledge that any collection and compilation of data entails the likelihood of some human and machine errors, omissions, delays, interruptions, and losses, including inadvertent loss of data or damage to media which may give rise to loss or damage. Under no circumstances will “BBW”, its affiliates, officers, directors, employees, or agents be liable to you or any third person for damages or costs arising from your use or inability to use the Web site or the Services. “BBW” makes no representation or warranty with respect to the accuracy, completeness, or currentness of the Web site's content; and “BBW” specifically disclaims any other warranty, express, implied, or statutory, including any warranty of merchantability or fitness for a particular purpose. “BBW” shall not be liable on account of any such errors, omissions, delays, or losses unless caused by its gross negligence. You agree that in no event will “BBW” be liable for the results of your use of the Web site, your inability or failure to conduct your business, or for indirect, special, or consequential damages. You further agree that in no event will the total aggregate liability of “BBW” for any claims, losses, or damages arising under this Agreement and the Services performed hereunder, including negligence, exceed the amount paid by you to
your-lovestory.com for the Services during the term of membership in which the cause for complaint occurred, even if “BBW” has been advised of the possibility of such potential claim, loss, or damage. The foregoing limitation of liability and exclusion of certain damages shall apply regardless of the success or effectiveness of other remedies.

•  Indemnity. You agree to indemnify your-lovestory.com, “BBW”, and its affiliates, officers, directors, employees, and agents from any and all third party claims, liability, damages, and/or costs (including but not limited to attorney's fees) arising from your use of the Services in a manner that violates or is alleged to violate this Agreement, or from any charges or complaints made by other users against you.

•  Refunds. You specifically acknowledge that “BBW” is not obligated to offer a refund on any valid, properly executed order for any Services. When you send a letter and it is transferred to the intended recipient's inbox, this is considered a properly executed order. Letters that go unread or from which you receive no reply are still considered properly executed orders and do not entitle you to a refund. “BBW” is not obligated to offer a refund based upon your personal success (or lack thereof) when using the Web site or the Services. Dissatisfaction with the Web site or any Services offered within does not entitle you to a refund. Nor are refunds issued due to your failure to familiarize yourself with the functionality of the Web site, resulting in incorrect use of the Web site. This includes instances such as accidentally sending duplicate emails, or closing a chat session prematurely.

• Chargeback Policy.
Credit Packages:
By using the Web site and/or Services, you hereby acknowledge and agree that the purchase and receipt of any credit package listed on the Web site, which provides the ability to utilize Services through your-lovestory.com, including, but not limited to email messaging, instant messaging, and live video streaming, constitutes value received.
Furthermore, you covenant and agree that you will not initiate any cardholder chargebacks in an attempt to secure a refund, as any attempt to do so would constitute a violation of the terms of the purchase. Having acknowledged value received, you hereby agree that any effort to initiate such a chargeback would be a misrepresentation of fact and could be construed as an act of fraud.

Memberships:
By using the Web site and/or Services, you hereby acknowledge and agree that the purchase and receipt of any membership listed on the Web site, which provides access and the option to utilize Services through
your-lovestory.com, including, but not limited to email messaging, instant messaging, and live video streaming, constitutes value received. You acknowledge and agree that charges associated with each membership will automatically renew each month, and should you no longer wish to use a membership, you agree to cancel by accessing the "Cancel Membership" link located within your "My Account" page on the Web site. You acknowledge and accept that failure to cancel does NOT excuse you from paying any charges associated with the membership. Furthermore, you covenant and agree that you will not initiate any cardholder chargebacks in an attempt to secure a refund, prior to, after, or in lieu of canceling your membership, as any attempt to do so would constitute a violation of the terms of the purchase. Having acknowledged value received, you hereby agree that any effort to initiate such a chargeback would be a misrepresentation of fact and could be construed as an act of fraud.

Membership Renewal Notice:
Your automatic monthly membership renewal will take place each month on the anniversary of the date that you initiated your membership. If for any reason your renewal transaction is unable to be processed, “BBW” will make up to two additional attempts to renew your membership before any loss of privileges occurs with your existing membership level. If a second and/or third attempt is required to renew your membership, the anniversary date for subsequent monthly renewals will become the date upon which the renewal transaction takes place. If after three attempts, the automatic membership renewal transaction has not been satisfied, your membership will automatically revert to the Bronze membership allowing you free membership level access to the Web site without disruption to your available credits or any “pay per use” services.


Gift Deliveries:
By using the Web site and/or Services, you hereby acknowledge and agree that the purchase of any gift delivery service listed on the Web site, and subsequent confirmation of delivery, constitutes value received.
Furthermore, you covenant and agree that you will not initiate any cardholder chargebacks in an attempt to secure a refund, as any attempt to do so would constitute a violation of the terms of the purchase. Having acknowledged value received, you hereby agree that any effort to initiate such a chargeback would be a misrepresentation of fact and could be construed as an act of fraud.

•  Force Majeure. “BBW” will not be liable for any loss resulting from a cause over which it does not have direct control, including but not limited to failure of electronic or mechanical equipment or communication lines, telephone or interconnect problems, computer viruses, unauthorized access, theft, operator errors, severe weather, hurricanes, earthquakes, natural disasters, strikes or other labor problems, or governmental restrictions.
•  Severability. In case any one or more provisions contained in this Agreement shall, for any reason, be held invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not effect any other provision hereof and this Agreement shall be construed as if such invalid, illegal, or unenforceable provision had not been contained herein.
• Governing Law. This agreement shall be deemed for all purposes to have been entered into in the State of Florida. The Member agrees he is subject to the jurisdiction of the State of Florida and waives any right to defense for lack of jurisdiction. Venue for any and all disputes between the Member and “BBW”, including, but not limited to, any claims for violation of any statute, contract, tort or common law, shall lie exclusively in Pinellas County, Florida or the United States District Court, Middle District of Florida, Tampa Division. Member and “BBW” agree to waive any claim for jury trial in any dispute between Member and “BBW”. This Agreement shall be Governed by and construed in accordance with the Laws of the State of Florida.

USER AGREEMENT

By using this web site (your-lovestory.com), you agree to abide by the following rules and regulations:

• I am at least 18 years of age. (21 in states where 18 is not the age of majority)
• I will not dispense content that: is patently offensive (sexually or otherwise); displays pornographic or sexually explicit material of any kind; involves the transmission of "Spam" or "Junk Mail;" promotes information that is false or misleading; engages in commercial activities such as contests and pyramid schemes; and provides instructional information about illegal activities.
• I will use the Services in a manner consistent with all applicable laws and regulations.
• I will not attempt to place within the public portion of my Profile, including, but not limited to the "About Me" and "Looking For" sections, postal addresses, URLs, instant message IDs, email addresses, or any other form of personal contact information. Should I choose to do so, I understand I may be denied access to any current and/or future use of the Services.
• I will not attempt to place within my outgoing correspondence provided through the Services, including, but not limited to emails and/or instant messages, telephone numbers, postal addresses, URLs, instant message IDs, email addresses, or any other type of personal contact information. Should I choose to do so, I understand I may be denied access to any current and/or future use of the Services.
• I will not post, distribute, or reproduce any copyrighted material, trademarks, or other proprietary information without obtaining prior written consent from the owner of such rights.
• I hold myself solely responsible and liable for any interactions and disputes between myself and other your-lovestory.com members.
• I agree to indemnify your-lovestory.com, Best Brides World Wide, LLC. , Its employees, affiliates, officers, agents, and other partners, from any loss or liability arising from my use of the Services in violation of this Agreement, or from any charges or complaints made by other users against me.
• I acknowledge that this User Agreement may be modified at any time, such changes to become effective on the day in which they are posted. I agree to review this User Agreement periodically to check for any such modifications.

DISCLAIMER

“BBW” cannot guarantee nor does it warrant any specific results from use of the Web site and/or the Services. The Web site and Services are distributed on an "as is" basis. “BBW” is not responsible for any incorrect or inaccurate Content posted on the Web site, regardless of its origin. You acknowledge that errors, omissions, and interruptions in the availability of Services may occur, and hold “BBW” harmless from any loss or damage incurred by you as a result of such occurrences.
“BBW” is not responsible for the conduct, whether online or offline, of any Member of the Web site. “BBW” has no obligation to monitor disputes between Members. “BBW” will not be responsible for any loss or damage resulting from the interactions between users of the Web site, whether online or offline.

Each ICAR is responsible for validating it's own ladies. They are contractually bound to conduct these validation practices in a professional and ethical manner. Should any ICAR fail in this regard, they are in violation of their contractual agreement, and “BBW cannot be held liable for any damages incurred by you as a result.
